Forum Overview

Besides the achieved results, according to Mr. Ngo Xuan Nam, after 1 year of implementing Order 248 and Order 248, there are still many challenges for exporters. Specifically, the software https://cifer.singlewindow.cn has both implemented and continuously upgraded; Change the product approval authority of China Customs. Online registration on the registration system of China Customs requires businesses to use technology and foreign languages in Chinese and English. Some businesses still do not understand the process and regulations for online business registration. The operation of declaring information on the system is wrong for self-opening accounts that are not approved by competent authorities, so it will be affected when carrying out customs clearance procedures of enterprises.

In addition, enterprises when identifying HS code codes lack information, so they are deviated from reality, hindering the customs clearance process of enterprises. Many businesses have not learned about and grasped China's national standards and regulations on food safety, so they have not met China's requirements for ensuring food safety (Order 249) (must manage hygiene and safety). food safety according to HACCP principles ).

Order 248 Regulations on management and registration of enterprises exporting agricultural products and food to the Chinese market, including 28 articles and 4 chapters, was issued on April 12, 2021 and took effect from January 1, 2022.

Order 249 Regulating China's import and export food safety management measures including 79 Articles and 6 Chapters, was issued on April 14, 2021 and took effect on January 1, 2022.

In order to meet the conditions for export registration to China, Mr. Ngo Xuan Nam recommended, businesses need to set up and operate a food safety and hygiene management system according to HACCP principles (section 3, Article 3. 5, Order 248).

For enterprises with quick registration in 2021, it is necessary to quickly supplement registration information on the CIFER system before June 30, 2023 (point 5, item 1, Note 353). Enterprises need to actively contact the competent authority that submitted the application or SPS Vietnam Office for guidance. After the above time limit, if the enterprise has not completed the additional documents, the product code will be removed from the list of China Customs.

“Businesses also need to pay attention to common errors when declaring online such as: Account information; office/manufacturing address; local competent authority; Latin/scientific name of the product; contact person information; Note... Enterprises also need to firmly grasp the regulations of Order 248, Order 249 and regularly update information from specialized agencies to make appropriate adjustments " , emphasized Mr. Ngo Xuan Nam.

According to Mr. Ngo Xuan Nam, enterprises exporting to the Chinese market need to develop and implement measures to control food safety risks. Besides, must comply with China's national laws and standards and regulations on food safety. At the same time, prepare conditions for factory food hygiene and safety , set up a record-keeping system to ensure traceability to meet inspection before and after registration for export to China. Monitor food safety violations of China Customs to take timely preventive or remedial measures (if subject to warnings) according to the guidance of competent authorities.

“ Enterprises that have done quick registration and been granted a code need to quickly complete the application before June 30, 2023 Vietnamese enterprises need to raise awareness in compliance to meet the requirements in these two orders ” noted Mr. Ngo Xuan Nam again.

On the side of the local government, Mr. Ngo Xuan Nam said that it is necessary to strengthen the management and supervision of food safety of production and processing establishments; continue to guide enterprises in the process of registering the manufacturing enterprise code for export to the Chinese market to ensure that they meet the regulations on food safety management of this market. At the same time, strengthen the exchange of technical issues to create conditions for Vietnamese enterprises to complete the registration of documents and registration of enterprise codes to meet the requirements of Order 248 and Order 249. Continue communication. and disseminating knowledge, regulations and guidelines for implementation of registration.

Information on regulations of the Chinese market, Dr. Phan Thi Thu Hien - representative of the Plant Protection Department (Ministry of Agriculture and Rural Development) - said that currently, Vietnam has 7 traditional export fruits including mango, dragon fruit, longan, litchi. , watermelon, rambutan, jackfruit and 5 types of exports under the form of signing the Protocol, namely mangosteen, black jelly, durian, banana and sweet potato, are allowed to be exported to the Chinese market.

"Currently, China is no longer an easy market and there is a drastic change. Specifically, the Chinese side requires strict control of goods crossing the border, especially in the form of border trade and small quotas. At the same time, China also requires negotiations to open the door for each type of product; Re-sign the Export Protocol for 8 traditional fruits, the management form is similar to that of mangosteen and durian. ; Requires declaration of growing area code and packing facility", Dr. Phan Thi Thu Hien information.
